Minimum Wage, Overtime and Misclassification

Some cities in California have enacted local minimum wages, as well. These rules apply to workers who are paid on an hourly basis. These laws require that hourly workers be paid at least the minimum hourly rate, and they also require overtime compensation when workers exceed certain hours daily and weekly. Generally, an employee who works more than 8 hours a day or 40 hours a week, must be paid at the overtime rate by their employer. Notice that these laws only apply to hourly workers. A worker can be exempt from overtime requirements if they are paid on a salary basis. As you can imagine, some employers classify all their workers as salaried employees in order to avoid paying overtime. The law has strict requirements for when an employee can properly be classified as exempt from overtime pay. Simply calling a worker’s income a salary is not enough to secure exempt classification under the law.

Some misclassification cases involve misclassifying employees as independent contractors. There are employers who use this classification because it saves them on costs. Independent contractors are responsible for paying their own taxes and unemployment insurance.
